VICTOR STEPHEN MARTINEZ [#90504], 49, of Oxnard was disbarred Aug. 20, 2003, and was ordered to comply with rule 955.

In a default proceeding, the State Bar Court found that Martinez did not comply with rule 955, as ordered in a 2002 discipline.

A nine-month suspension was imposed for misconduct in two client matters, including failing to perform legal services competently, properly maintain client funds or refund unearned fees and for improperly withdrawing from employment.

Martinez also was disciplined in 1988 for two misdemeanor convictions for driving under the influence and hit and run.

VICTOR STEPHEN MARTINEZ [#90504], 44, of Oxnard was suspended for 90 days, stayed, and placed on probation for two years, effective May 27, 1998. He was ordered to pass the MPRE.

In November 1996, Martinez was convicted of drunk driving and hit and run driving, both misdemeanors.

In aggravation, Martinez' misconduct involved multiple acts of wrongdoing. In addition, Martinez had a prior similar conviction and was on criminal probation when the current misconduct occurred.

In mitigation, Martinez, who was admitted to the State Bar in 1979, has no prior record of discipline. He cooperated fully with the bar's investigation and disciplinary proceedings.
