LAURA V. KERL [#99031], 40, of San Francisco was disbarred Jan. 17, 1997, and ordered to comply with rule 955.

Kerl's disbarment order followed a consolidated default proceeding involving multiple acts of misconduct with three clients and including failure to return unearned legal fees, communicate, perform services competently, promptly pay medical liens and misappropriation of client funds and commingling.

During another default proceeding which was tried on the same date, Kerl was found culpable of misconduct in three separate client matters and of practicing law while she was on involuntary inactive status due to her failure to comply with MCLE requirements.

Although that case was not final at the time of the disbarment order, the hearing department of the State Bar Court considered it an aggravating circumstance in the consolidated proceeding.

In its decision, the bar court determined that Kerl demonstrated indifference by failing to render an accounting of fees and providing a refund to one client. She also failed to take action to assist another client in restoring his credit record, which was tarnished when Kerl failed to pay his medical liens.

The court expressed its concern for public protection and Kerl's current physical condition and ability to practice law, after it received a letter from a doctor indicating she has a history of substance abuse and is currently dealing with depression.
