BILL JAY WEIR JR. [#98824], 63, of Yucca Valley was disbarred Oct. 9, 2011, and was ordered to comply with rule 9.20 of the California Rules of Court.

In a default proceeding, the State Bar Court found that Weir committed four acts of misconduct while representing a client who paid a $1,500 advance fee for him to set aside a judgment and oppose levies of his bank account. Weir did no work on the case and didn’t refund unearned fee when the client fired him.

The bar court found that he failed to perform legal services competently, refund unearned fees, account for client funds or cooperate with the bar’s investigation.

Weir was disciplined twice previously. “It is evident that the prior instances of discipline have not served to rehabilitate (Weir) or to deter him from further misconduct,” wrote bar court Judge Richard Honn, adding that disbarment “is the only adequate means of protecting the public from further wrongdoing by respondent.”

BILL JAY WEIR JR. [#98824], 48, of Joshua Tree was suspended for 30 days, stayed, placed on two years of probation with a requirement that he make restitution, and was ordered to take the CPRE or the MPRE within one year. The order took effect Dec. 13, 1996.

Weir stipulated that in his representation of two clients, he failed to communicate with them, respond to their status requests, adequately supervise his staff, perform legal services competently, return a client's file or protect his client's interests when he withdrew from representation.

In the first matter, a legal assistant accepted a bankruptcy case and took a fee, but never told Weir. Despite frequent telephone calls and trips to Weir's office by the client, Weir never contacted him. He never returned the unearned fee.

In a personal injury case, someone in Weir's office told the client he would contact her medical providers because her bills had not been paid. The doctors were never contacted and the client had to stop medical treatment. A new attorney was unable to contact Weir or obtain the client's file, and Weir did not execute the substitution of attorney form. He did not respond to status requests by either the client or the new attorney.

In mitigation, most of Weir's troubles resulted from poor supervision of staff. He was going through a bitter divorce and child custody battle at the time and experienced severe financial problems. He has not been disciplined in 15 years of practice.
