LAWRENCE HOODACK [#97629], 56, of Anaheim was suspended for three years, stayed, and placed on three years of probation with a six-month actual suspension. The order took effect Sept. 24, 2010.

Hoodack successfully completed the Alternative Discipline Program, after demonstrating a connection between his misconduct and his mental health issues. He stipulated to four acts of misconduct during his representation of five people who were seriously injured by a drunk driver. Hoodack represented all five, despite potential conflicts of interest, and he did not get their consent to the concurrent representation.

He did not maintain a proper balance in his client trust account and he misappropriated $9,130.72 of his clients’ settlement proceeds, an act of moral turpitude. He took four years to pay four of the clients what they were owed and he failed to perform legal services competently by not promptly resolving his clients’ medical liens, not obtaining court approval of the minor clients’ settlements, and he did not respond to a request for information from a victim’s fund.

Hoodack was suspended in 1994 for 11 acts of misconduct in a single client matter. In mitigation, he cooperated with the bar’s investigation, demonstrated remorse and had a mental health issue at the time of the misconduct.
