May 29, 2016 VICENTA E. MONTOYA-TORRES [#97192], 65, of Las Vegas, was disbarred May 29, 2016 and ordered to comply with rule 9.20 of the California Rules of Court. Montoya-Torres was disbarred after her default was entered after she failed to respond to a notice of disciplinary charges. Because she did not seek to have the default set aside or vacated within 90 days, she was disbarred and the charges against her deemed admitted.Montoya-Torres failed to comply with the conditions attached to her disciplinary probation. She failed to submit one quarterly report to probation on time and did not submit four other quarterly reports.She had three prior records of discipline. In 1997, she was privately reproved for failing to perform services competently, inform the client of significant developments or cooperate and participate in a disciplinary investigation. She was publicly reproved in 2009 for failing to perform legal services competently or inform the client of significant developments. In 2011, she was suspended for failing to comply with the conditions surrounding her public reproval.November 18, 2011 VICENTA E. MONTOYA-TORRES, 61, of Las Vegas was suspended for two years, stayed, placed on three years of probation and was ordered to take the MPRE within one year. The order took effect Nov. 18, 2011. Montoya-Torres stipulated that she did not provide proof of attendance at ethics school or completion of the MPRE, conditions attached to a 2009 public reproval. In addition, she received a private reproval in 1997.In mitigation, Montoya-Torres has health problems and displayed remorse. |
