Discipline Summaries

October 11, 2003

CHRISTOPHER ALAN MORGAN [#96950], 65, of Santa Ana was suspended for one year, stayed, placed on two years of probation with a five-year actual suspension and was ordered to take the MPRE and prove his rehabilitation. Credit towards the actual suspension will be given for the interim suspension that began in 1998. The order took effect Oct. 11, 2003.

Morgan was convicted in 1997 of one count of solicitation to commit sexual assault. He was charged after a conversation with an undercover police detective in Huntington Beach who posed as the operator of an escort service. The local police department had placed an ad in the Orange County Register as part of a sting operation.

Morgan was not arrested, but was charged nearly a year later with solicitation and convicted at trial.

The conviction was upheld by the court of appeal and the Supreme Court denied Morgan's petition for review, with two justices dissenting.

Morgan then went to the federal courts, including the Supreme Court, but all petitions were denied.

Because the crime was a felony, the State Bar Court placed Morgan on interim suspension Jan. 14, 1998. The court also found that the felony involved moral turpitude.

In mitigation, no minor or female was involved, the court in the criminal proceeding found that Morgan is not a pedophile and he was not required to register as a sex offender, and he successfully completed a three-year criminal probation and weekly psychological therapy for four years.

He cooperated with the bar's investigation and was remorseful.
