Discipline Summaries

November 28, 1996

GARY LLOYD MARSH [#96825], 39, of Stateline, Nev., was suspended for two years, stayed, placed on two years of probation with an actual 30-day suspension, and was ordered to take the MPRE within one year. The order took effect Nov. 28, 1996, and the actual suspension ended Dec. 28.

Marsh pleaded guilty in 1995 to one misdemeanor count of brandishing a firearm. The State Bar Court found that his conduct did not constitute moral turpitude but did warrant discipline. He lived in an apartment complex where several gang members resided, and the gun waving incident was an "emotional and spontaneous reaction to the 'last straw' in a long string of prior incidents," according to a stipulation Marsh reached with the bar.

In four civil actions, Marsh failed to communicate with clients or perform legal services competently. The first case was dismissed after Marsh failed to respond to a discovery request, a motion to compel and a motion for summary judgment, and he did not appear at a hearing.

He failed to file a responsive pleading in another case, miscalculated the statutory deadline and did not appear at a hearing.

Marsh also failed to pursue a civil case and a bankruptcy petition for two other clients.

In mitigation, he had no record of discipline since his 1981 admission to the bar and suffered from depression. He helped new counsel in efforts to have two default judgments set aside. In one case, he advanced substantial amounts in costs and fees and, as a result, suffered serious financial setbacks which affected that matter as well as other cases.
