SUSAN KATHLEEN HOLLIDAY [#96472], 66, of City of Industry, was disbarred Feb. 21, 2015 and ordered to comply with rule 9.20 of the California Rules of Court and make restitution. Holliday was disbarred after her default was entered for failing to file a response to a notice of disciplinary charges filed against her. Because she did not seek to have the default set aside within 180 days as required under rule 5.85 of the State Bar’s Rules of Procedure, she was disbarred and the charges were deemed admitted. Holliday engaged in acts involving moral turpitude and failed to return unearned fees, comply with conditions of her disciplinary probation, perform legal services with competence, pay client funds promptly or cooperate in a State Bar investigation. Holliday’s misconduct involved four matters. In one of them, she did not return $1,488 in unearned fees to a client and issued a check to her client when she was at least grossly negligent in not knowing there were insufficient funds in her bank account to pay the check. She also failed to abide by the terms of an earlier discipline case by not submitting one quarterly report to probation or proof of restitution on time and failing to make certain specified restitution payments. Holliday was ordered to pay $5,088 plus interest in restitution. Holliday previously resigned with charges pending in 1993 and was later reinstated in 2001. In 2012, she was suspended for failing to return unearned fees to clients.

SUSAN KATHLEEN HOLLIDAY [#], 63, of Irwindale was suspended for two years, stayed, placed on two years of probation with a four-month actual suspension and she was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect June 21, 2012.

Holliday stipulated that she did not refund $6,400 in unearned fees to clients who hired her to settle a dispute with some builders and to sue a property development group located in Mexico. Although Holliday resolved the dispute, the clients later decided not to file suit and asked for a refund of that portion of their $12,500 advance fee. Holliday refunded $1,500 but still owes $6,400.

Holliday was disciplined in 1991. In mitigation, since resuming her practice in 2001, she has structured it to ensure a proper management of her caseload. She also has worked pro bono since 2008 for an organization that helps disadvantaged young women.
