EUGENE TOM [#96214], 47, of San Francisco was suspended for five years, stayed, and placed on probation for five years on condition that he actually be suspended for 18 months and until he has shown proof of his fitness to practice law, effective Nov. 21, 1996. He also was ordered to pass the MPRE and comply with other conditions of probation from a June 1996 order.

Credit for the period of actual suspension was given for the period of interim suspension which began Jan. 1, 1996.

In this conviction referral matter, Tom pleaded guilty in federal court to misdemeanor theft of government funds amounting to $13,506.

From 1984-95, Tom was employed as a field attorney with the National Labor Relations Board (NLRB), traveling throughout northern California to litigate labor disputes.

An audit of Tom's travel expenses revealed major inconsistencies between claims he made for reimbursement for business travel and days where it was confirmed he worked in the San Francisco office of the NLRB.

From 1992-95, Tom fraudulently claimed and received $13,506 in travel reimbursements from the NLRB. At his criminal court sentencing, Tom was placed on probation for three years and ordered to pay $525 in fines and assessments.
