ROBERT ROMAN [#93369], 64, of Chino Hills, was disbarred May 29, 2016 and ordered to comply with rule 9.20 of the California Rules of Court.

Roman’s default was entered after he failed to respond to a notice of disciplinary charges. Because he did not seek to have the default set aside or vacated, he was disbarred and the charges against him were deemed admitted.

Roman held himself out as entitled to practice law when he wasn’t and failed to cooperate with a State Bar investigation in one matter. In another matter, he accepted fees from a non-client, improperly withdrew from employment, misappropriated client funds and failed to refund unearned fees, deposit client funds in trust or cooperate with a disciplinary investigation. In a third matter, he failed to comply with his probation and made misrepresentations to the Office of Probation.

Roman had one prior record of discipline. In 2013, he was suspended for misconduct including improperly withdrawing from representation and failing to perform legal services with competence, keep his client reasonably informed about significant developments, cooperate with the State Bar or promptly release his client’s file upon termination of employment.

August 8, 2013

ROBERT ROMAN [#93369], 61, of Santa Ana, was suspended for two years, stayed, placed on three years’ probation with an actual 60-day suspension and ordered to take the MPRE and pay restitution. The order took effect Aug. 8, 2013.

Roman stipulated to misconduct in two matters, including failing to perform legal services with competence, failing to keep a client informed of significant developments in a matter, failing to take reasonable steps to avoid foreseeable prejudice to a client, failing to cooperate or participate in a State Bar investigation and failing to return client papers or property. In one of the matters, he was hired to represent a woman in a personal injury matter but failed to keep her informed of key dates and information in her case, which led to sanctions against the client on two different occasions. Roman also failed to appear for trial in the matter which led to the dismissal of the client’s case. Roman did not seek to vacate the dismissal and only informed her that case had been dismissed when she visited his office months later. Roman was ordered to pay the woman $2,564 plus interest in restitution.

In the other matter in 2011, Roman failed to respond to a request by another attorney that he turn over a former clients’ file.

In mitigation, Roman has had no other discipline in 32 years of practicing law and was suffering from severe depression at the time of his misconduct.
