February 19, 2006 MARK EMIL MONTPAS [#93365], 53, of Los Angeles was suspended for two years, stayed, placed on two years of probation with a 60-day actual suspension and was ordered to prove his rehabilitation and take the MPRE within one year. The order took effect Feb. 19, 2006. Montpas pleaded no contest in 2004 to theft of property, a misdemeanor involving moral turpitude. As a court-appointed attorney, he submitted a declaration regarding attorneys fees claiming that he had interviewed his client several times at county facilities. As a result, he was paid $1,920 by the county. However, he was unable to substantiate the information he provided. In mitigation, Montpas has no record of discipline, he cooperated with the bar’s investigation, and he repaid the money plus a fine, completed 25 hours of community service and did not practice law for six months. |
