February 9, 1997

WALTER WENKO [#93053], 52, of El Monte was suspended for three years, stayed, and placed on probation for three years with an actual 90-day suspension and until he makes restitution. If the actual suspension exceeds two years, he must prove rehabilitation. Wenko also was ordered to take the MPRE within one year and to comply with rule 955. The order took effect Feb. 9, 1997.

Wenko stipulated to 17 counts of misconduct, the majority for failing to perform the legal work for which he was hired. He also failed to appear in court for numerous hearings.

One case was dismissed but later reinstated due to Wenko's failure to appear. The statute of limitations ran on another case and Wenko failed to communicate with his client. He also was sanctioned by the court on several occasions and ordered to pay more than $900 in costs when he failed to appear six times for scheduled depositions.

He did not communicate with one client for two years, and did not return another client's file for four months.

Wenko was disciplined in 1995 for failing to cooperate with State Bar investigations.

In mitigation, Wenko has been depressed for five years as a result of the disintegration of his marriage.

WALTER WENKO [#93053], 51, of Arcadia was suspended for 30 days, stayed, and placed on probation for one year. The order took effect Dec. 20, 1995.

Although several charges the bar had brought against Wenko were dismissed, he stipulated that he failed to respond to the bar's letters to him about allegations of professional misconduct or cooperate with its investigation. Wenko has no prior record of discipline.
