October 30, 2014 JOHN MICHAEL MCKENNA [#91174], 65, of Tustin, was suspended from the practice of law for 30 days and ordered to take the MPRE. He was also placed on two years’ probation and faces a one-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect Oct. 30, 2014. McKenna stipulated that he failed to perform with competence, failed to promptly respond to a client’s reasonable status inquiries and failed to promptly return a client’s file. The misconduct stemmed from a 2012 workers’ compensation matter he was hired to handle. McKenna was supposed to file to substitute in for another attorney but he never did and never provided any services of value in the case. In mitigation, McKenna entered into a prefiling stipulation with the State Bar. He had two prior records of discipline, a 2000 private reproval for failing to maintain records of client funds in his possession and sharing fees with a non-lawyer and a 2001 suspension for failing to perform with competence, keep a client informed of significant events, respond to the client’s requests for status reports or promptly return a client’s file. September 22, 2001 JOHN MICHAEL McKENNA [#91174], 52, of Tustin was suspended for six months, stayed and placed on probation for two years. The order took effect Sept. 22, 2001. McKenna represented a client on a contingency fee basis in a real estate action against her realty company. He filed a complaint, but did not return his client’s phone calls, respond to an inquiry about the status of her case, return her file or appear at two hearings. His failure to perform resulted in the dismissal of the case.McKenna was publicly reproved in 2000 for failing to maintain records of client funds in his possession and for sharing fees with a non-lawyer. |
