WARREN JOSEPH SMALL JR. [#90945], 56, of Riverside was suspended for two years, stayed, placed on two years of probation and was ordered to take the MPRE within one year and prove his rehabilitation. The order took effect Dec. 25, 2008.

He stipulated to misconduct in two matters.

He was hired to handle a child support and child custody matter by a client who paid a $2,500 advance fee. The client told Small she would be out of the country at the time of a hearing and asked him to obtain a continuance. Instead, he told the opposing counsel that he would request a continuance the day of the hearing. He failed to appear. The other lawyer also did not attend the hearing because Small had said he planned to seek a continuance.

The hearing went forward without either lawyer. Small stipulated that he failed to perform legal services competently.

In a second matter, he filed a divorce petition for his client but substituted out of the case a short time later. He provided an accounting for the $4,900 advanced fee that reflected a $3,312 credit owed the client but he did not refund the money for almost a year, when the bar was investigating him.

He stipulated that he failed to promptly refund unearned fees.

Small was disciplined twice previously. He received a public reproval in 2003 for failing to perform legal services competently and obey and court order, and in 1993, he was placed on a 90-day suspension with two years’ probation for failing to properly supervise an employee.

In mitigation, Small furnished evidence of an exemplary record of involvement in bar association and community service activities as well as character letters from 12 references.
