PHILLIP K. HOGE [#90501], 42, of Pasadena was disbarred Nov. 17, 1996, and ordered to comply with rule 955 of the California Rules of Court.

Hoge failed to comply with a previous rule 955 order and committed other acts of misconduct.

In 1992, Hoge failed to complete a divorce matter for a client and did not return unearned fees. He also neglected to return the client's repeated telephone calls and a letter requesting a status report on his case. In 1995, he did not respond to State Bar queries regarding the case.

In another matter, Hoge received a six-month suspension in July 1995 and was ordered to make restitution. He also received a two-year stayed suspension, was placed on probation and ordered to comply with rule 955. However, he failed to file the rule 955 affidavit.

In its decision, the hearing department of the State Bar Court found Hoge's prior record of discipline to be an aggravating factor. He was privately reproved in 1992 and in 1994 received a one-year stayed suspension.

The hearing department also found that Hoge, admitted to the bar in 1979, demonstrated indifference for his misconduct and failed to participate in the disbarment proceedings prior to the entry of default.
