DIRK MCKINLEY EASTMOND [#89470], 62, of Sandy, Utah, was suspended from the practice of law for 90 days and placed on probation for two years. He must pass the State Bar Ethics School test or complete six hours of live, in-person Minimum Continuing Legal Education-approved courses in legal ethics in Utah or California. The order took effect Aug. 28, 2016.

Eastmond stipulated that he had been charged with domestic violence stalking in Utah, had pleaded guilty to one count of the charges and was sentenced to 365 days in jail with all but 15 days suspended. He was later arrested in connection with a domestic violence incident and his probation was revoked. He sent his wife, from whom he was separated pending their divorce, vulgar, harassing and threatening text messages and voicemail messages. He also had a physical altercation with his live-in girlfriend. He was sanctioned by the Utah State Bar. Those facts and circumstances involved moral turpitude.

In aggravation, he committed multiple acts of misconduct. In mitigation, Eastmond had no prior record of discipline in California, but in 2002 he received a private admonition in Utah for errors in drafting a power of attorney form for a client. He presented testimony from four attorneys and a personal friend who spoke of their belief in his good character.
