STEVEN LEWIS WEINER [#87553], 55, of Walnut Creek was suspended for two years, stayed, placed on three years of probation with a six-month actual suspension and was ordered to take the MPRE within one year and comply with rule 9.20. The order took effect Nov. 30, 2007.

Weiner stipulated that he failed to maintain client funds in trust and he commingled client and non-client funds.

He negotiated a $75,000 settlement on behalf of a personal injury client and deposited the money in his client trust account. A dispute arose over payment to one of the client’s doctors and the client instructed Weiner not to disburse any funds without his authorization. Weiner allowed the balance in his trust account to fall below the required amount. He also deposited non-client funds into the account.

Weiner was privately reproved in 1997 for mishandling his client trust account.

In mitigation, he was suffering from extreme emotional difficulties at the time of the misconduct.
