STANLEY AROUTY [#87477], 53, of Los Angeles was suspended for one year, stayed, and was placed on two years of probation with an actual 30-day suspension. The order took effect Feb. 9, 1997.

Arouty was disciplined and placed on probation in 1994 for misconduct that resulted from his partnership with a lawyer who was under investigation by the State Bar and who resigned, leaving the practice in complete disarray.

As a condition of his probation, Arouty was required to make restitution and to keep any balance of his unpaid restitution in his client trust account. Although Arouty complied with several conditions of his probation, he did not submit proof that he maintained the balance on deposit.

In a second matter, Arouty represented a client who faced criminal charges in an altercation with a woman. Arouty advised his client to make the woman unavailable for legal service and for testimony so the prosecutor would not be able to proceed with the case. By doing so, he violated the Rules of Professional Conduct.

In mitigation, many of the cases Arouty was to review were in a storage facility maintained by the bar, which had taken over the practice of Arouty's former partner. Many of the files were hard to locate and some essential records were missing, which contributed to Arouty's delay in complying with his probation conditions.
