September 28, 2005 JOHN ROBERT NOBLE [#87153], 53, of Irvine was suspended for three years, stayed, placed on four years of probation with an actual 18-month suspension and was ordered to make restitution, prove his rehabilitation, take the MPRE and comply with rule 955. The order took effect Sept. 28, 2005. Noble stipulated to four counts of misconduct in a divorce case. He filed a petition for dissolution after the client paid advance fees of $1,250 but then did nothing further and the client was unable to contact him. The petition was a two-page check-off-the-box form.He stipulated that he failed to perform legal services competently, communicate with his client or refund unearned fees and he withdrew from representation without protecting his client’s interests.Noble has three prior disciplines. In 2003, he stipulated to misconduct in six matters — he failed to appear in court and/or did not return his clients’ phone calls or refund unearned fees and he improperly withdrew from representation in two cases. In 2004, his probation was revoked because he did not comply with probation conditions and, later the same year, he was suspended for not filing a rule 955 affidavit.December 17, 2004 JOHN ROBERT NOBLE [#87153], 52, of Irvine was suspended for two years, stayed, placed on two years of probation with a one-year actual suspension and was ordered to take the MPRE, comply with rule 955, make restitution and comply with fee arbitration conditions. The order took effect Dec. 17, 2004. Noble failed to comply with rule 955, as required by a 2003 disciplinary order. He did not submit to the Supreme Court an affidavit stating that he notified his clients and other interested parties about his suspension.The underlying discipline was imposed when Noble stipulated to misconduct in six consolidated cases. He failed to appear in court or return his clients’ phone calls or refund unearned fees, improperly withdrew from representation and formed a law partnership with a non-attorney.August 22, 2004 JOHN ROBERT NOBLE [#87153], 51, of Irvine was revoked, the previous stay of suspension was lifted and he was actually suspended for two years and until he makes restitution. He also was ordered to comply with rule 955. The order took effect Aug. 22, 2004. Noble did not comply with probation conditions imposed in a 2003 disciplinary order: he did not submit a quarterly report, cooperate with his probation monitor or initiate binding fee arbitration proceedings pertaining to his clients’ unearned fee claims.In the underlying discipline, Noble stipulated to misconduct in six consolidated cases. The misconduct involved failing to appear in court and/or not returning his clients’ phone calls or refunding unearned fees. He improperly withdrew from representation in two cases. In one of the matters, he improperly formed a law partnership with a non-lawyer.November 21, 2003 JOHN ROBERT NOBLE [#87153], 51, of Irvine was suspended for two years, stayed, placed on two years of probation with an actual nine-month suspension and was ordered to make restitution, take the MPRE and comply with rule 955. If the actual suspension exceeds two years, he must prove his rehabilitation. The order took effect Nov. 21, 2003. Noble stipulated to misconduct in six consolidated cases. Six of the matters were criminal cases in which Noble failed to appear in court and/or did not return his clients’ phone calls or refund unearned fees. He improperly withdrew from representation in two cases.In the sixth matter, he set up a personal injury law practice with a non-lawyer who obtained case files, negotiated settlements, hired and paid staff and paid Noble’s salary. Forming a law partnership with a non-attorney is a violation of the Rules of Professional Conduct.In mitigation, Noble has no record of discipline since his 1979 admission to the bar. |
