October 19, 1996

DONALD SCOTT WALLACE [#86687], 45, of West Covina was suspended for one year, stayed, placed on three years of probation with an actual 90-day suspension, and was ordered to make restitution, take the MPRE within one year and comply with rule 955. The order took effect Oct. 19, 1996.

Wallace was disciplined in 1992 with a requirement to take the California Professional Responsibility Examination. When he did not do so, he was suspended from July 10, 1993, to June 15, 1994. He also was suspended from Aug. 16, 1993, to June 28, 1994, for failing to pay his bar dues.

While suspended, he represented clients in two separate personal injury cases for periods of about three months.

In a workers' compensation case, Wallace failed to comply with a judge's restitution order. Wallace had been substituted out of the case without his knowledge and he was erroneously paid some fees to which he was not entitled. However, he did not respond to another attorney's demand that the money be returned, file a requested brief with the court, or appear at several subsequent hearings.

Wallace's poor financial circumstances and a repayment agreement were given some weight as mitigating circumstances. He also made some effort to determine what acts constituted the practice of law while he was suspended.
