January 14, 2010 ANA MARIA PATINO [#86606], 61, of Laguna Beach was disbarred Jan. 14, 2010, and was ordered to comply with rule 9.20 of the California Rules of Court. In a default proceeding, the State Bar Court found that Patino failed to file an affidavit, as required by rule 9.20, that she had notified her clients, opposing counsel and other pertinent parties of her suspension. Failure to comply with the rule is grounds for disbarment. She was placed on interim suspension in 2008 following a felony conviction for stalking. She also was publicly reproved in 1993 and suspended in 2006 for committing acts of moral turpitude by misappropriating another attorney’s identity and then using it to gain access to Claralaw.net, a private subscription service operated under the auspices of the California Public Defenders Association.June 9, 2006 ANA MARIA PATINO [#86606], 58, of Laguna Beach was suspended for one year, stayed, placed on three years of probation with an actual 30-day suspension and was ordered to take the MPRE. The order took effect June 9, 2006. Patino stipulated that she committed acts involving moral turpitude by using another attorney’s identity and personal information and by signing the other lawyer’s name on money orders, forms and documents. She was a subscriber to Claralaw.net (Claranet), a private subscription service operated under the auspices of the California Public Defenders Assn. and limited to licensed criminal defense lawyers. She was suspended from using the service because she violated its rules and her user agreement.Patino obtained the personal information of another lawyer, signed up with Claranet, completing a form and a user agreement, purchasing two money orders and using the other lawyer’s name in Claranet e-mail.Patino was publicly reproved in 1993.In mitigation, her misconduct was aberational, she performed community service and paid a fine. Her actions were the result of a concern about the effect on her clients of losing access to the service. |
