July 19, 1998

The probation of FREDERICK HILL STEIN [#86535], 48, of Dix Hills, N.Y., was revoked, the previous stay of suspension was lifted, and he was actually suspended for two years. The order took effect July 19, 1998. Stein was disciplined in 1996 with a stayed three-year suspension and three years of probation with conditions including a one-year actual suspension and quarterly probation reports. He submitted two reports late, but failed to submit two others or to prove that he attended ethics school and a client trust account record-keeping class. As a result, his probation was revoked.

The discipline resulted from failing to perform legal services competently in two civil cases and failing to return client files and unearned fees in one of the matters.

Because he filed late a rule 955 affidavit attesting that he notified all clients and other pertinent parties of his suspension, he was placed on two years of actual suspension in 1997, with a requirement that he prove his rehabilitation.

Stein has lived in New York since 1993, and according to the court, has shown no interest in returning to California to practice.

Stein stipulated that he was disciplined in 1996 with an order that required him to comply with rule 955.

He filed the affidavit late.

Stein left California in 1993 and had no clients or other interested parties to notify of his suspension.

October 19, 1996

FREDERICK HILL STEIN [#86535], 46, of Dix Hills, N.Y., was suspended for three years, stayed, placed on three years of probation with an actual one-year suspension, and was ordered to take the CPRE within one year and comply with rule 955. The order took effect Oct. 19, 1996.

Hired by a couple to represent them in a civil matter, Stein never returned his clients' phone calls and eventually disconnected his phone. His clients fired him and requested that he return their $3,000 advance. He never did so.

The State Bar Court found that Stein failed to perform legal services competently, keep his clients informed about developments in their case, or return client files and advanced fees.

In a second matter, Stein settled a civil case with an insurance firm. He mailed the settlement check to his client, who endorsed and returned it to him, and he deposited the draft in his trust account. Several months later, Stein's bank was closed and the FDIC paid out all insured depositors, including Stein. More than a year later, the settlement check still had not been cashed and Stein's client had not received her funds.

Because there was no evidence that the client ever demanded payment of the settlement proceeds, the State Bar Court did not find that Stein violated any rules or misappropriated funds. The court did find, however, that Stein failed to complete the legal services for which he was hired.

Stein also failed to cooperate with the bar's investigation.

In mitigation, he has no record of discipline since his admission to the bar in 1977.
