PATRICK LEE LUND [#86371], 60, of Newport Beach, was disbarred Oct. 16, 2014 and ordered to comply with rule 9.20 and make restitution.

Lund stipulated to misappropriation and failing to maintain funds in his client trust account in one client matter. In 2011, he was hired to represent a man in a business dispute involving the man’s company. A week or so later, he received two wire transfers totaling $200,000 that he deposited in his client trust account. He was supposed to hold the money there until the opposing party authorized him to release it. Instead, he misappropriated $199,992.19 of the funds for his own purposes. Between Nov. 1, 2011, when the opposing party authorized the release of the funds, and Jan. 13, 2012, the client asked repeatedly for the money. Lund then told the client he had misappropriated it. Lund paid the client $130,500 as partial restitution. He was ordered to pay back the remaining $69,500.

In mitigation, he entered into a pretrial stipulation with the State Bar.

Lund had two prior records of discipline. In 2012, he was suspended for failing to perform legal services with competence. The year before, he received a public reproval for failing to provide written disclosure to a client of a personal relationship with a third party in a matter, knowing the third party would be substantially affected. He also failed to promptly refund unearned fees and sought an agreement that a client withdraw a disciplinary complaint against him.
