DAVID A. PINES [#82644], 55, of Woodland Hills was suspended for two years, stayed, placed on two years of probation and was ordered to take the MPRE within one year. The order took effect Aug. 27, 2005.

Pines stipulated to four counts of misconduct in two matters.

While serving as general counsel for a company, he filed suit against a debtor called Silver Screen. He also defended his company, its president and one of its businesses in an unlawful detainer matter.

In the Silver Screen matter, he told the company president he would bring in a collector to recover the debt, although he never did so. He also billed the company for drafting a complaint but never filed or served a complaint. He did not respond to four e-mails from the company president seeking information about the case.

Pines misrepresented that Silver Screen had been served with a summons and complaint, that he had filed a request for entry of default that was rejected by the court, and that a collector had met with and made a settlement offer to Silver Screen.

In the unlawful detainer matter, Pines did not respond to the company president’s inquiries.

Pines stipulated that he failed to perform legal services competently, respond to a client’s inquiries, and committed acts of moral turpitude by making misrepresentations. He also did not return client files for six months.

In mitigation, Pines has no record of discipline and he presented evidence of his good character. The misconduct occurred at a time when the relationship between Pines and the company president was deteriorating; they eventually ended the relationship.
