MICHAEL EDWARD KELLY [#80255], 55, of Phoenix was suspended for two years, stayed, placed on two years of probation with a 45-day actual suspension and was ordered to take the MPRE within one year. The order took effect Dec. 17, 2004.

Kelly was disciplined in Arizona in 2003 for 10 acts of misconduct. He stipulated that the misconduct there warranted discipline in California for his failure to perform legal services competently.

He was a sole practitioner who delegated responsibility for the day-to-day administration of his office to his secretary and legal assistant. Without his knowledge, the secretary communicated with Kelly’s clients and others who believed they were his clients, accepted funds and refunded fees, intercepted Kelly’s phone calls and erased voicemail messages, and lied to clients about actions taken on their behalf and the status of court proceedings and their cases. She also prepared, signed and filed various pleadings without Kelly’s knowledge, affixed court file stamps or date stamps to false documents and affixed judges’ signature stamps to fictitious orders that she sent to the clients.

Kelly stipulated that in 10 client matters, he failed to supervise non-attorney personnel, resulting in failures to perform legal services competently, return client papers, refund unearned fees or respond to client inquiries.

In mitigation, he had no prior record of discipline, he demonstrated remorse and cooperated with the bar’s investigation.
