January 4, 1998 STEVEN HARRY FRANCESCHI [#80057], 45, of Modesto was suspended for four years, stayed, and was placed on four years of probation with a nine-month actual suspension. He will receive credit for the actual suspension which began Aug. 14, 1996. The order took effect Jan. 4, 1998. Franceschi pleaded no contest in 1996 to possession of cocaine and possession of drug paraphernalia. As a result of his criminal conviction, he was placed on interim suspension and ordered to comply with rule 955 by notifying all clients and other pertinent parties of his suspension and by filing an affidavit stating that he had done so with the Supreme Court. He stipulated that he filed the affidavit 30 days late.Franceschi had no clients when placed on interim suspension, and he filed the affidavit late because at the time it was due, he was enrolled in an in-house drug rehabilitation program which discouraged outside communication. In addition, he had practiced law for 19 years without any discipline, no clients were harmed by his behavior, and he cooperated with the bar’s investigation.August 14, 1996 STEVEN H. FRANCESCHI [#80057], 43, of Modesto was placed on interim suspension effective Aug. 14, 1996, following his conviction of possession of a controlled substance, a felony, and misdemeanor possession of paraphernalia for unlawful use, a misdemeanor.
