October 11, 2013 MANUEL ORTEGA [#79519], 69, of Montebello, was disbarred Oct. 11, 2013 and ordered to comply with rule 9.20 of the California Rules of Court and pay restitution. Ortega was disbarred after his default was entered because neither he nor his attorney filed a response to the notice of disciplinary charges filed against him. Because no effort was made to vacate the default within 180 days, as required by rule 5.85 of the bar’s Rules of Procedure, he was disbarred and the charges deemed admitted.Ortega filed a late and insufficient declaration of compliance with rule 9.20 required by a 2011 disciplinary order and engaged in the unauthorized practice of law when he was not an active member of the State Bar.In 2011, Ortega received a two-year actual suspension after stipulating to nine counts of misconduct in eight matters, most of which involved clients seeking help with immigration problems who were left to deal with non-lawyers working in Ortega’s office. Ortega was previously disciplined in 1995 for trust account violations and in 1997 for not complying with probation conditions.August 7, 2011 MANUEL ORTEGA [#79519], 66, of Montebello was suspended for five years, stayed, placed on five years of probation with a two-year actual suspension and until he makes restitution to seven clients and proves his rehabilitation, and he was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect Aug. 7, 2011. Ortega stipulated to nine counts of misconduct in eight matters. Six involved clients seeking help with immigration problems who dealt with nonlawyers working in Ortega’s office. In those matters, he either did not do the work,or did not account for client funds or refund unearned funds. He also stipulated in one matter that he aided a person in the unauthorized practice of law.In a personal injury case, Ortega did no work and another lawyer told the client the statute of limitations had expired. Ortega also misused his client trust account by commingling personal and client funds.Ortega was suspended in 1995 for trust account violations and in 1997 for not complying with probation conditions.In mitigation, he cooperated with the bar’s investigation and demonstrated remorse.February 6, 1997 MANUEL ORTEGA [#79519], 52, of Montebello was suspended for 30 days, stayed, and placed on probation for one year for violating the terms of a previous probation. The order took effect Feb. 6, 1997. Ortega initially was disciplined in 1995 for client trust account violations in three personal injury matters. As part of a three-year probation, he was required to file quarterly probation reports which were to include a certification from a certified public accountant verifying the status of his trust account. He did not file the CPA reports, leading to the current discipline. In mitigation, he did not file the reports because he had no clients and no active accounts. Ortega cooperated with trial counsel in resolving this matter and has not practiced law for more than a year. |
