March 19, 2006 JANIS LOUISE TURNER [#79217], 59, of San Diego was suspended for one year, stayed, and placed on two years of probation. The order took effect March 19, 2006. Turner stipulated that she failed to comply with probation conditions attached to a 2004 disciplinary order. She did not submit one probation report and submitted another late, and she did not provide proof of her attendance at ethics school.The underlying discipline was imposed for Turner’s failure to perform legal services competently or preserve client secrets.May 23, 2004 JANIS LOUISE TURNER [#79217], 57, of San Diego was suspended for 30 days, stayed, placed on one year of probation and was ordered to take the MPRE within one year. The order took effect May 23, 2004. Turner stipulated that she failed to perform legal services competently in a breach of contract matter. Although the clients had another attorney, he delegated some of the work to Turner. She filed an answer to the complaint and a cross-complaint and then, without the clients’ consent, signed a request for dismissal and later a dismissal of the cross-complaint.When a new attorney sought to reverse her actions, Turner signed a declaration stating that the clients specifically requested a dismissal of the cross-complaint.Although the clients never authorized Turner to file the dismissal, by providing the declaration to opposing counsel, Turner failed to preserve the secrets of her clients or maintain their confidence inviolate.In mitigation, Turner has no prior record of discipline. |
