MARC RAYMOND TOW, 61, of Overland Park, Kansas, was disbarred Aug. 15, 2012, and was ordered to comply with rule 9.20 of the California Rules of Court.

Tow’s default was entered when he did not appear at trial on charges that he committed eight counts of misconduct in two matters. He said he had moved to Kansas and did not intend to practice law again. Any attorney who does not seek to have his default set aside or vacated within 180 days is then subject to disbarment.

In one case in the underlying matter, the State Bar Court found that Tow failed to maintain client funds in a trust account, account for or promptly pay out client funds, and he represented adverse interests and committed acts of moral turpitude by misappropriating $10,000 in advance costs and making misrepresentations to his client.

In the second matter, the bar court found that Tow failed to perform legal services competently or refund unearned fees.
