DAVID MATTHEW MCKIM [#77396], 62, of Santa Rosa, was suspended from the practice of law for 60 days and ordered to take the MPRE. He was also placed on two years’ probation and faces a one-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect Nov. 21, 2014. The State Bar Court found McKim culpable of failing to avoid the representation of adverse interests and failing to obey a court order. McKim’s misconduct stems from his representation of two clients who later became business adversaries. One of the men sued the other man in four lawsuits over the course of four years. The court had repeatedly disqualified McKim from acting as opposing counsel to the plaintiff in the suit because of their past attorney-client relationship and his knowledge of client secrets relevant to the issues in the lawsuits. Undeterred, McKim continued to represent the defendant in those lawsuits between 2007 and 2012. In mitigation, McKim had no prior record of discipline and presented evidence of his good character.
