September 23, 2000

ROBERT JAY BARTH [#75776], 57, of Beverly Hills was disbarred Sept. 23, 2000, and was ordered to comply with rule 955.

Barth did not meet the requirements of a disciplinary order last year that he comply with rule 955 by notifying his clients and all other pertinent parties of his suspension and filing an affidavit to that effect with the Supreme Court.

That was his seventh disciplinary order since 1991; Barth has not been eligible to practice since April 1998.

In 1991, he was given two stayed suspensions for failure to complete legal services competently twice, respond to client inquiries, refund unearned fees or cooperate with the bar’s investigation. He also improperly withdrew from employment.

He was given an actual 75-day suspension the following year for violating the terms of his probation and for the unauthorized practice of law. His probation was revoked in 1994, and, in 1997, he was disciplined twice for misconduct, including failing to perform legal services competently or respond to client inquiries and for again failing to comply with probation conditions.

In recommending Barth’s disbarment, State Bar Court Judge Carlos Velarde wrote, Barth “has demonstrated an unwillingness to comply with the professional obligations and rules of court imposed on California attorneys as indicated by his seven instances of prior misconduct although he has been given several opportunities to do so.” Velarde also pointed out that Barth did not participate in the final disciplinary proceedings.

July 22, 1999

ROBERT J. BARTH [#75776], 56, of Beverly Hills was placed on a six-month actual suspension July 22, 1999, and was ordered to comply with rule 955.

Barth was ordered to file quarterly mental health reports as part of a 1997 discipline, and he failed to do so.

He has five prior records of discipline, including three client abandonments, two probation violations, two failures to perform legal services competently or communicate with clients, and one instance of unauthorized practice.

November 9, 1997

ROBERT JAY BARTH [#75776], 54, of Beverly Hills was suspended for one year, stayed, and was placed on one year of probation, to run consecutive to and subject to the conditions of an earlier probation. The order took effect Nov. 9, 1997.

Barth stipulated that he did not file three quarterly probation reports, conditions of a 1994 disciplinary probation.

Barth was suspended in a separate matter in March, charged with five counts of misconduct in two matters. He has four other prior records of discipline, including two in which he abandoned clients and two which were probation violation matters.

In mitigation, he did not harm any clients. He also has suffered from extreme depression and has experienced serious family problems.

March 26, 1997

ROBERT JAY BARTH [#75776], 53, of Beverly Hills was suspended for one year, stayed, placed on two years of probation, and was ordered to take the professional responsibility examination. The order took effect March 26, 1997.

Barth was charged with five counts of misconduct in two matters.

In the first, he failed to perform legal services competently and did not respond to his clients' reasonable status inquiries. He represented the defendants in a federal case, but did not answer the complaint on behalf of one client or appear at a hearing. As a result, a default judgment was entered against Barth's client. He never told the client about the default.

Barth assisted new counsel to help set aside the default and made restitution of $25,000 to the client.

The second matter involved a personal injury case which was dismissed as a result of Barth's failure to pursue it. That client hired a new lawyer, but it was too late to set aside the dismissal. Barth's offer of restitution was not pursued.

Barth offered significant mitigating testimony. He went through a period of intense family turmoil, beginning in 1985, because his daughter had been sexually molested for several years by a relative. She then was arrested, suffered drug problems and ran away repeatedly. Barth and his wife divorced.

Barth himself suffered extreme depression, but after two years of therapy, he has reduced his caseload and stress and is functioning efficiently.

Barth has four prior records of discipline, all during the same time period. Two cases involved abandoning clients and two were probation violations stemming from those cases. He also practiced law while suspended.
