October 19, 1996 The previously ordered probation of DANIEL JAMES FAGAN [#74370], 45, of San Diego was extended for one year, beginning Oct. 19, 1996. Although the bar had sought revocation of Fagan's probation, there was enough mitigating evidence for the State Bar Court to simply extend the probation for one year.Fagan was initially disciplined as a result of convictions in Shasta and Siskiyou counties for writing or passing bad checks. Because he violated the terms of his probation, the Supreme Court in 1993 suspended him for two years, stayed, and placed him on three years of probation with an actual one-year suspension. As part of that probation, Fagan was required to attend ethics school within one year and submit quarterly probation and psychiatric reports. It was his failure to do so that led to the most recent discipline.Fagan is a recovering alcoholic and when he completed a rehab program, he mistakenly believed a modification of his probation put a stay on some of the requirements. Because he was in a residential program for one year, he was unable to work and could not afford to pay the fee to attend ethics school.He has since done so and has filed all delinquent reports. Fagan continues to undergo treatment and counseling. |
