July 5, 2014 KEITH SCOTT WALKER [#73047], 62, of Claremont, was suspended for one year, stayed, placed on two years’ probation with a 30-day actual suspension and ordered to take the MPRE. The order took effect July 5, 2014. The State Bar Court found Walker culpable of five counts of misconduct, including failing to perform legal services with competence, provide a client with a significant document, provide an accounting to a client, promptly respond to reasonable client inquiries or cooperate in a State Bar investigation.Walker’s misconduct involved one client matter. In 2011, a man hired Walker to represent him in a dispute with his brother and sister-in-law involving a family trust. The following year, the matter went to mediation and settled. When the client paid Walker for his remaining fees and costs, he asked Walker to provide him with a copy of the settlement check and an accounting, but he did not.The client again asked for a copy of the check and the accounting the following month, along with a copy of his late family member’s death certificate and a copy of a release for a piece of property he was to receive. After getting no response, the client called him twice and sent him two letters. Due to Walker’s failure to take any action to enforce the settlement, the client has been required to pay a $175-per-year premium on a bond. In May 2013, Walker provided the client with a copy of the check and the following month he provided him with an accounting.Walker failed to cooperate with a State Bar investigation by not responding to two letters from an investigator seeking information related to the client’s complaint.Walker received some mitigation for health and personal problems he was experiencing at the time of his misconduct, for cooperating with the State Bar by entering into an extensive stipulation and for good character and evidence of pro bono work.Walker had one prior record of discipline. In 2009, he received a public reproval after stipulating to two counts of failing to perform legal services with competence, two counts of failing to respond to reasonable client inquires and one count of failing to return client documents. |
