January 16, 1998

GEORGE NUNEZ [#72123], 53, of Fresno was suspended for four years, stayed, and placed on four years of probation with a one-year actual suspension and until he makes restitution. If the actual suspension exceeds two years, he must prove rehabilitation. He also was ordered to take the MPRE and comply with rule 955. The order took effect Jan. 16, 1998.

Nunez stipulated to misconduct in three client matters.

In the first, he negotiated a $25,000 settlement for his client in a sexual harassment case. When the client tried to cash the check Nunez issued, it was returned for insufficient funds. By not maintaining sufficient funds in his client trust account, Nunez misappropriated client funds.

Hired by a couple to handle a civil matter, Nunez never responded to their telephone calls or pursued the matter, and his clients lost their cause of action. He failed to return their unearned fees and he withdrew from representation without protecting their interests.

In a criminal case, Nunez accepted advance payment from the defendant’s mother. When the clients decided not to hire Nunez, he refused to refund any fees.
