September 17, 2009

RONALD GRADY FINCH [#70822], 60, of Scottsdale was suspended for one year, stayed, placed on two years of probation and was ordered to take the MPRE within one year. The order took effect Sept. 17, 2009.

A client hired Finch to reverse an order of removal from the Immigration Court in Arizona. Although he filed a motion, he did not notify the client about a hearing or of the deadline to file some required motions. Finch filed one motion six weeks after the deadline, and it was denied.

As a result of the late filing, the court determined Finch’s client abandoned her effort.

Finch stipulated that he failed to perform legal services competently.

He was disciplined by the State Bar of Arizona, but did not report the reprimand to the California bar within 30 days, as required.

He has a prior record of discipline in Arizona, which did not come to the attention of the California bar until the current case arose.

In mitigation, he self-reported his conduct to the Arizona bar, has continued to represent the same client before the Board of Immigration Appeals and cooperated with both bars’ investigations.
