December 4, 1996 The probation of BRIAN PAUL PETRUNICH [#69275], 52, of Los Angeles was revoked, the stay of suspension was lifted, and he was actually suspended for 60 days, beginning Dec. 4, 1996. In 1994, Petrunich was given a stayed suspension and placed on probation with conditions including filing quarterly probation reports, completing six hours of MCLE credit in law office management and joining the bar's Law Practice Management section. He did not file two reports on time or complete his MCLE hours.Petrunich has a record of four other discipline proceedings. He was publicly reproved in 1987 for failing to perform legal services competently and improper withdrawal from employment. He was again publicly reproved in 1992 for failure to communicate and improper withdrawal from employment. As a result of failing to comply with conditions of that reproval, he was placed on probation and given a 60-day stayed suspension in 1994. It was his failure to comply with that probation that led to the current order.In addition, he was suspended and placed on probation in 1995 for misconduct involving three clients which included failure to communicate, perform legal services competently, promptly release a client's file, promptly pay out funds to medical lienholders or cooperate with three State Bar investigations.December 1, 1995 BRIAN PAUL PETRUNICH [#69275], 51, of Los Angeles was suspended for two years, stayed, and placed on probation for two years with 30 days actual suspension, effective Dec. 1, 1995. He also was ordered to make restitution. Petrunich was found culpable of multiple acts of wrongdoing including failure to communicate to clients, perform legal services competently, return client case files and promptly pay medical liens. In one instance, Petrunich was employed by two clients involved in an auto accident. Although both clients received personal injury settlements, Petrunich failed to pay all the medical liens and his clients received notices of threatened legal action from a credit bureau. When the clients requested proof of payment by Petrunich, he failed to provide it. In aggravation, Petrunich has a prior record of discipline. In October 1987, he received a public reproval for failure to perform legal services competently, improper withdrawal and failure to communicate. He was again publicly reproved in July 1992 for similar reasons. In June 1994, he was disciplined by the bar for failing to totally comply with conditions of the July public reproval. At that time he received a 60-day stayed suspension and two years probation. Petrunich's misconduct resulted in a negative credit record for one of his clients. |
