April 19, 2013 PAUL HAROLD OTTOSI [#69250], 67, of Lancaster was suspended for one year, stayed, and placed on two years’ probation with an actual 60-day suspension, and was ordered to take the MPRE. The order took effect April 19, 2013. Ottosi sought review of a State Bar Court hearing judge’s finding that he had violated the conditions of a private reproval, claiming that the hearing judge erred by improperly admitting confidential information and excluding evidence that would have exonerated him. A three-judge panel upheld the judge’s ruling, but increased the discipline to include the actual 60-day suspension.Ottosi failed to comply with the conditions of the 2008 private reproval by, among other things, refusing to return a call from a probation officer and failing to follow rules outlined in a plan that the Lawyer Assistance Program put together for him.Ottosi received limited mitigation due to both the emotional difficulties he was experiencing at the time of his misconduct and the fact that he cooperated by stipulating to certain facts in his discipline case. |
