DONALD ERWIN LEVINSON, 63, of Los Angeles was suspended for one year, stayed, placed on two years of probation with a 30-day actual suspension and was ordered to take the MPRE within one year. The order took effect Oct. 28, 2011.

Levinson stipulated that he commingled personal funds in his client trust account and failed to maintain the required balance in the account.

For nearly two years, he used the account to pay his monthly parking. Over 11 months, he authorized 41 withdrawals for payment of his law office payroll and related fees and during the same time period, he issued 41 checks from the trust account for advertising expenses. He also used the account to pay various personal expenses and wrote a check against insufficient funds to his clients’ doctor.

Levinson was disciplined in 1994 for misconduct in four cases, including failing to perform legal services competently and misusing his client trust account.

In mitigation, he suffered from depression and had medical problems.
