MARK IRA ROSE [#62557], 62, of Beverly Hills was disbarred Dec. 28, 2011, and was ordered to comply with rule 9.20 of the California Rules of Court.

Rose misappropriated more than $20,000 from two clients whose medical bills were referred to collection.

In a personal injury matter that he handled on a contingency fee basis, Rose received a settlement check for $15,000 that he deposited in his client trust account. He allowed the balance in the account to fall to $2.62 and stipulated that he misappropriated $9,997 belonging to the client. He failed to resolve four medical liens although he eventually paid two medical providers with funds belonging to another client. He also gave the client $3,000 from funds belonging to other clients. He never satisfied one lien.

In a second matter, he represented a mother and daughter in a personal injury action for which he received a $1,500 settlement for the daughter. By not maintaining the proper balance in his trust account, he misappropriated $759 from the client. He also received an $18,000 settlement check for the mother but allowed the balance in his trust account to fall to $2.62. His client had outstanding medical bills that Rose did not resolve and he misappropriated $11,997.38 from her.

He stipulated that he committed 13 acts of misconduct: in addition to the misappropriation, he failed to perform legal services competently, maintain or pay out client funds or respond to client inquiries.

In mitigation, Rose cooperated with the bar’s investigation and he went through a difficult divorce that resulted in financial and emotional stress. He also became the caretaker for his ailing father.
