Rodriguez violated the terms of a 1995 probation by failing to file quarterly reports or certificates from a certified public accountant that he is properly maintaining his client trust account.He had stipulated to trust account violations, failure to perform legal services competently, failure to communicate with clients and the unauthorized practice of law.At the time of Rodriguez’ misconduct, he was a municipal court commissioner.In mitigation, Rodriguez was depressed due to the humiliation caused by the discipline order, had family problems, suffered from alcoholism and was suspended from his job because of the discipline. He submitted letters attesting to his good character, attends AA meetings, has a long record of pro bono activities and presides over a successful drug court. |
