EDUARDO A. RIVERA [#62528], 63, of Calexico was suspended for one year, stayed, placed on one year of probation with an actual 30-day suspension and he was ordered to take the MPRE within one year. The order took effect March 31, 2011.

Rivera stipulated that he breached his fiduciary duty to a client.

Brian Pye and Daniel Robinson, who owned a convenience store and gas station in an unincorporated area of Calexico, had a falling out and agreed to sell the business, Portico Express Inc., and place the proceeds ? $35,437 ? in an interest-bearing account maintained by Rivera. The funds were to remain in the account until the men could work out their differences through arbitration or litigation. Rivera represented Robinson.

When Robinson demanded the funds, Rivera explained he could not release them. However, he filed a civil complaint on behalf of Robinson Ford Sales, another company the client owned, seeking money allegedly owed by Portico Express. Although another lawyer was the attorney of record, he did nothing substantive on the case.

The court filed a default judgment against Portico for more than $74,000. Pye was never notified about the suit or the judgment.

Rivera wrote a check for $31,137 to Robinson Ford and informed Pye, who then sued him, Robinson and others. Pye won damages of $16,437.

In mitigation, Rivera had no prior discipline record, he cooperated with the bar’s investigation, submitted evidence of extensive pro bono work and community service and he demonstrated remorse.
