PETER L. NISSON, 62, of Laguna Beach was suspended for one year, stayed, placed on two years of probation with a 90-day actual suspension, and he was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect July 4, 2012.

Nisson stipulated to five acts of misconduct in three loan modification cases. In each matter, he violated state law by accepting an advance fee for the work before it was performed. He stipulated in one matter that he also failed to perform legal services competently or refund an unearned fee.

Nisson was suspended in 1998 for failing to promptly pay out client funds or deposit client funds in a client trust account.

In mitigation, he cooperated with the bar’s investigation and demonstrated remorse.
