March 6, 2005 JOHN J. NESE [#62264], 55, of Los Angeles was suspended for 30 days, stayed, placed on 18 months of probation and was ordered to take the MPRE in one year. The order took effect March 6, 2005. Nese stipulated that he improperly shared fees with a non-lawyer and misused his client trust account.Nese primarily practices dependency law, but a small percentage of his practice is devoted to personal injury. He occasionally used the services of an Armenian-speaking paralegal, who referred several clients to him over many years. Nese used the paralegal in some of the cases and compensated him with a percentage of the fees he earned after the cases settled.He also did not maintain a general office bank account but instead used his client trust account and routinely commingled personal and client trust funds.In mitigation, Nese has no prior discipline record, he cooperated with the bar’s investigation, acted in good faith and presented testimony about his good character. No clients were harmed by his actions. |
