February 13, 2015 DAVID ANDREW LUNA [#61953], 66, of Los Angeles, was suspended from the practice of law for 30 days. He was also placed on two years’ probation and faces a one-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect Feb. 13, 2015. Luna’s disciplinary probation was revoked after he failed to file a quarterly report to the Office of Probation on time or file proof of restitution by deadline. In mitigation, Luna’s health problems may have contributed to his failure to comply with the conditions of his probation. He now has an attorney friend who helps monitor his practice if other health issues arise. Luna was previously suspended in 2013 for misconduct that included failing to respond to a client’s numerous inquiries about the status of his case, not contacting his client to discuss his legal strategy or the fact that he had ceased work on his case, not providing the client with an accounting for the $7,500 advance fee the client paid him and not refunding any portion of the money that he did not earn. July 24, 2013 DAVID ANDREW LUNA [#61953], 64, of Los Angeles, was suspended for one year, stayed, placed on two years’ probation and ordered to take the MPRE and pay restitution. The order took effect July 24, 2013. Luna stipulated to misconduct in one client matter in which he was hired to represent a client and his business partners concerning a real property investment deal with the redevelopment agency for the city of San Bernardino. Luna made a series of missteps during the course of representing the client, including not responding to the client’s numerous inquiries about the status of his case, not contacting the city regarding his client’s investment and not contacting his client to discuss his legal strategy or the fact that he had ceased work on his case. Luna also did not provide the client with an accounting for the $7,500 advance fee the client paid him and did not refund any portion of the money that he did not earn.Luna was ordered to pay $7,500 plus interest in restitution. In mitigation, Luna had no prior discipline in more than 36 years of practicing law |
