February 18, 2011 PATRICK EARL CATALANO [#60774], 64, of San Diego was suspended for one year, stayed, placed on one year of probation and was ordered to take the MPRE within a year. The order took effect Feb. 18, 2011. Catalano stipulated that he commingled funds in his client trust account. He deposited a stale settlement check for $45,000 in his trust account, but told his client he would not release any funds until the check cleared. The bank reversed the deposit, the balance dropped and Catalano commingled his funds with client funds to use on an “as needed†basis.In mitigation, Catalano had no prior discipline record, he cooperated with the bar’s investigation and no clients were harmed. |
