June 19, 1998 JAIME PENA [#59842], 51, of San Jose was suspended for four years and until he attends ethics school and passes the MPRE. Credit toward the suspension is to be given for an interim suspension which began March 26, 1994. The order took effect June 19, 1998. In 1992, Pena was charged with three counts of committing a lewd and lascivious act on his daughter, who was 15 at the time. He was convicted of one count, completed his sentence and complied with his criminal probation.Pena has steadfastly denied any improper conduct, and his daughter, after reaching the age of 18, recanted her testimony. Pena is appealing the conviction. He has been suspended from the practice of law since 1994.In mitigation, he has no other criminal convictions. |
