JAMES ALLEN MACY [#57677], 63, of San Diego was suspended for three years, stayed, placed on probation for three years with an actual suspension of 18 months, and he must provide proof of rehabilitation, take the MPRE and comply with rule 9.20. The order took effect Feb. 11, 2010.

In violation of State Bar rules, Macy placed more than $30,000 in an office safe rather than in his client trust account while working for the wife of a man arrested for Internal Revenue Service-related disputes. The money was to be held until it was determined whether the government had a claim to it. Macy later received almost $100,000, which he did place in his trust account. However, he took out fees for himself and two other lawyers handling the case and did not provide an up-to-date accounting of the money. It took more than two years for Macy to file the appropriate accounting.
