November 3, 1995 ROBERT C. KENDRICK [#57474], 52, of San Francisco was suspended for 30 months, stayed, and placed on probation for three years with an actual suspension for one year. He was ordered to make restitution, take the CPRE within one year and comply with Rule 955. The order took effect Nov. 3, 1995. Kendrick filed and settled an employment discrimination case for his client. However, he did not pursue collection of part of the settlement, kept a settlement check in his drawer without depositing it in his client trust account, misappropriated money withheld for court reporter fees and failed to disburse the undisputed portion of the settlement. In mitigation, Kendrick had no record of discipline since his 1973 admission to the bar, and he was distracted by an illness in his family at the time of the misconduct. |
