February 21, 2015 JOHN SHAFFER SMITH [#56107], 69, of Beverly Hills, was suspended from the practice of law for 90 days and ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. He was also placed on two years’ probation and faces a two-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect Feb. 21, 2015. Smith stipulated that he issued six checks drawn upon his Client Trust Account when he was grossly negligent in not knowing there were insufficient funds in the CTA to pay them. In mitigation, Smith presented evidence of his good character, was experiencing physical difficulties at the time of his misconduct and entered into a pretrial stipulation with the State Bar. He had three prior records of discipline. In May 1990, he was publicly reproved for two ethical violations, namely failing to perform services competently. In December 1996, he was privately reproved for seven advertising violations. His third discipline, in June 2002, was for failing to obtain court approval to settle a minor client’s personal injury claims and receiving more than the statutory limit for his attorney’s fee. |
