July 10, 2009 HOWARD MOORE JR. [#55228], 77, of Berkeley was suspended for one year, stayed, placed on one year of probation and was ordered to take the MPRE within one year. The order took effect July 10, 2009. Moore stipulated to three acts of misconduct in handling a criminal appeal for an incarcerated client. After obtaining two time extensions, he did not file the appeal. He sent a letter to his client, but it was addressed to the wrong unit and to an inmate with a different prison number.Moore took no further action and did not communicate with his client or the man’s ex-wife or former mother-in-law, who paid his legal expenses and sought a refund of their advance $10,000 fee.He stipulated that he failed to perform legal services competently or obey a court order and took no steps to avoid prejudice to his client when the representation was terminated.In mitigation, he cooperated with the bar’s investigation and he refunded the advance fee. |
